RosettaBooks/Random House Battle Continues

Random House has announced that its case against RosettaBooks is not over, in fact according Random general counsel Harriette K. Dorsen, "Last week's decision was only the first round in this judicial process."

The first round in this case, the preliminary injunction, was denied after the judge found that "because Random House is not likely to succeed on the merits of its copyright infringement claim and cannot demonstrate irreparable harm, its motion for a preliminary injunction should be denied." This in turn meant that RosettaBooks could continue selling the eight eBooks it had acquired electronic publishing sales rights for.

Since that time Random House has decided to appeal the decision. According to the company "Random House believes that the District Court misconstrued the prior cases dealing with 'new technological uses' by emphasizing the mode of delivery as opposed to the content. The e-book contains the exact same text as the print book."
